How much time do I have to file a reply?
You must file a reply to the Examination Report within 30 days of receiving it. Failing to reply within this deadline results in your trademark application being legally marked as 'Abandoned'.
What happens after we file the reply?
The Registrar will review our drafted response. If they are satisfied with the legal arguments, they will publish the trademark in the TM Journal. If they require more clarification, they will schedule a "Show Cause Hearing."
Is a Trademark Objection the same as Opposition?
No. An Objection is raised by the Government Examiner during the initial review. An Opposition is filed by a third party (a competitor) after the mark is published in the TM Journal.
Can a Section 11 objection be cleared?
Yes. Even if a similar mark exists, we can clear a Section 11 objection by proving that your goods/services fall under a different trade channel, or by proving honest concurrent use of the mark over a long period.
